Terms of Service

1. Acceptance of Terms

By creating an account, downloading the application, or otherwise accessing or using the PsyStat Nexus Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using the Service on behalf of an organization (such as a university, research institution, or company), you represent and warrant that you have the authority to bind that organization to these Terms, and "you" will refer to both you individually and the organization.

You must be at least 18 years of age, or the age of majority in your jurisdiction, to create an account and use the Service. If you are between 13 and 18 years of age, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

2. Description of Service

PsyStat Nexus is an AI-powered behavioral science statistics and research platform that provides:

• Statistical Analysis Tools — including descriptive statistics, inferential tests (t-tests, ANOVA, chi-square, regression, and more), effect size calculations, power analyses, and advanced methods such as Bayesian analysis, structural equation modeling, and multilevel modeling.
• Psychometric Analysis — reliability analysis (Cronbach's alpha, McDonald's omega), factor analysis (exploratory and confirmatory), item response theory, and scale development tools.
• AI-Powered Interpretation — natural language explanations of statistical results, study design recommendations, methodology suggestions, and research guidance powered by large language models.
• Research Planning Tools — study design assistance, sample size estimation, protocol templates, and curriculum tracking.
• Specialized Modules — domain-specific statistical tools for genomics, criminology, biometrics, social network analysis, medical statistics, cognitive science, and ethnography.

The Service is available as a mobile application (iOS and Android), a progressive web application, and through associated backend infrastructure. Features may vary by platform and subscription tier.

3. User Accounts and Responsibilities

3.1 Account Creation

To access most features of the Service, you must create an account by providing a valid email address and creating a password. You may also provide optional information such as your ORCID identifier, institutional affiliation, and research interests.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Choose a strong, unique password for your account.
• Not share your account credentials with any third party.
• Notify us immediately at moonlit-social-labs@proton.me if you suspect unauthorized access to your account.
• Not create multiple accounts for the purpose of abusing free-tier limitations or promotional offers.

3.3 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update your information as necessary to keep it accurate and complete.

4. Subscription Tiers and Pricing

PsyStat Nexus offers the following subscription tiers:

Researcher	$9.99/month	All Free features plus ad-free experience, expanded AI query limits, advanced statistical methods, data export, priority support, and access to all standard modules.
Scholar	$24.99/month	All Researcher features plus unlimited AI queries, all specialized modules, batch analysis, collaboration tools, API access, dedicated support, and early access to new features.

Pricing is subject to change. We will notify existing subscribers at least 30 days before any price increase takes effect. Annual billing options may be available at a discounted rate.

5. Payment Terms

5.1 Mobile Subscriptions

Subscriptions purchased through the iOS App Store or Google Play Store are processed by Apple or Google, respectively, and are subject to their terms of service and refund policies. Billing occurs through your App Store or Google Play account. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

5.2 Web Subscriptions

Subscriptions purchased through the PsyStat Nexus web application are processed by Stripe. You authorize us to charge the payment method on file for recurring subscription fees. All payments are processed in US Dollars (USD) unless otherwise noted.

5.3 Free Trials

We may offer free trial periods for paid subscription tiers. At the end of a free trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial period ends.

5.4 Refunds

For mobile subscriptions, refund requests must be directed to Apple or Google per their respective policies. For web subscriptions processed through Stripe, you may request a refund within 14 days of your initial purchase or renewal by contacting moonlit-social-labs@proton.me. Refunds are issued at our discretion and typically processed within 5–10 business days.

6. Intellectual Property

6.1 Your Data and Analyses

You retain full ownership of all data, datasets, analysis configurations, results, notes, and research materials that you input into or generate using the Service. We claim no ownership rights over your content. By using the Service, you grant us a limited, non-exclusive license to process, store, and display your content solely for the purpose of providing the Service to you.

6.2 Our Intellectual Property

The Service, including its software, design, algorithms, documentation, branding, logos, and all related intellectual property, is owned by PsyStat Nexus and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works of the Service without our prior written consent.

6.3 Feedback

If you provide feedback, suggestions, or ideas regarding the Service, you grant us a non-exclusive, royalty-free, perpetual, irrevocable license to use such feedback for any purpose, including improving the Service.

7. AI-Generated Content Disclaimer

The AI-powered features of PsyStat Nexus, including statistical interpretations, methodology recommendations, study design suggestions, and natural language explanations, are provided for informational and educational purposes only.

AI-generated content is not a substitute for professional statistical consulting, peer review, or expert judgment. You acknowledge and agree that:

• AI-generated interpretations and recommendations may contain errors, omissions, or inaccuracies.
• You are solely responsible for verifying the accuracy and appropriateness of any AI-generated content before using it in research publications, grant applications, clinical decisions, or any other professional context.
• AI outputs should be treated as a starting point for analysis, not as definitive conclusions.
• The AI does not have access to the full context of your research, and its suggestions may not account for domain-specific nuances, ethical considerations, or institutional requirements.
• We do not guarantee that AI-generated content will meet the standards of any particular journal, institution, funding body, or regulatory authority.

8. Acceptable Use

PsyStat Nexus is designed for legitimate research, educational, and professional purposes. You agree not to use the Service to:

• Fabricate, falsify, or manipulate research data — including generating fake datasets, manipulating statistical results to misrepresent findings, p-hacking, or engaging in any form of research misconduct.
• Produce fraudulent analyses — including creating misleading statistical reports intended to deceive reviewers, regulators, or the public.
• Violate research ethics — including processing data obtained without proper informed consent or IRB/ethics board approval.
• Infringe on intellectual property — including using the Service to reproduce copyrighted statistical methods, tests, or scales without authorization.
• Abuse the Service infrastructure — including attempting to circumvent rate limits, reverse-engineer the API, or interfere with the Service's operation.
• Engage in illegal activity — including using the Service in any manner that violates applicable local, state, national, or international law.
• Harm others — including using statistical analyses to discriminate, harass, or cause harm to individuals or groups.

We reserve the right to suspend or terminate accounts that violate this Acceptable Use policy, with or without notice.

9. Data Accuracy Disclaimer

All statistical computations, analyses, visualizations, and results provided by PsyStat Nexus are provided on an "as-is" and "as-available" basis.

While we strive for accuracy and use established statistical libraries (including SciPy, statsmodels, and pandas), we do not warrant that:

• Statistical computations will be free of errors or bugs at all times.
• Results will be identical to those produced by other statistical software packages (minor numerical differences may occur due to different algorithms, floating-point precision, or default settings).
• The Service will be suitable for any particular research purpose, regulatory submission, or clinical application.
• The Service will be available without interruption or that defects will be corrected immediately.

You are responsible for independently verifying critical results, especially those intended for publication, clinical use, or regulatory submissions. We recommend cross-checking important analyses with established statistical software when the stakes are high.

10. Limitation of Liability

To the maximum extent permitted by applicable law, PsyStat Nexus and its officers, directors, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, research materials, or analyses.
• Loss of revenue, profits, or anticipated savings.
• Errors in statistical computations or AI-generated content.
• Decisions made based on information provided by the Service.
• Rejection of research publications, grant applications, or regulatory submissions.
• Interruption of service or data breaches beyond our reasonable control.

In no event shall our total aggregate liability to you exceed the greater of (a) the amount you have paid to us in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

11. Termination and Account Deletion

11.1 Termination by You

You may terminate your account at any time by using the account deletion feature in the Settings section of the application, or by contacting us at moonlit-social-labs@proton.me. Upon account deletion:

• Your account will be immediately deactivated.
• All personal data, analysis data, saved results, notes, and AI conversation history will be permanently deleted from our systems within 30 days.
• Active subscriptions will be canceled; no further charges will be made. You will not receive a prorated refund for the remaining billing period unless required by applicable law.

11.2 Termination by Us

We may suspend or terminate your account, with or without notice, if:

• You violate these Terms or the Acceptable Use policy.
• Your use of the Service poses a security risk or could harm other users.
• We are required to do so by law or legal process.
• We discontinue the Service (with at least 60 days' notice where feasible).

11.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will continue in full force and effect.

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page.
• Notify you via email and/or an in-app notification at least 30 days before the changes take effect.
• Provide a summary of the material changes.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and delete your account.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts located in [Your Jurisdiction], and you consent to the personal jurisdiction of such courts.

Notwithstanding the foregoing, we may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of our intellectual property rights.
